Can You Refuse a Field Sobriety Test?

In most states, when you get your license it is implied that you will consent to field sobriety tests. Even though these implied consent laws exist, you can still refuse a field sobriety test. Before you elect to refuse a field sobriety test, you should know that there may be consequences for doing so. For example, refusing the tests may still result in your arrest or having your license suspended for 180 days or longer.

The proper way to refuse a field sobriety test is to cooperate with the police officer, answer the questions, produce your license, registration and proof of insurance. The police officer may want to engage in longer conversations as a way to gauge your level of intoxication or gain evidence that you have been drinking.
